J Marr has successfully applied for 100% trademark rights / Intellectual Property ownership of The Smiths name. His application has been accepted on whatever oaths or proclamations he has put forward. This action was done without any consultation to Morrissey, and without allowing Morrissey the standard opportunity of 'objection'. Amongst many other things, this means that Marr can now tour as The Smiths using the vocalist of his choice, and it also prohibits Morrissey from using the name whilst also denying Morrissey considerable financial livelihood.

Morrissey alone created the musical unit name 'The Smiths' in May 1982.

The whole thing is a puzzle, and it's clear we don't have the whole story. *Where* did he apply? In the States? If so, intellectual property rights are taken deadly seriously here. Did he falsely claim that there were no other living parties with interest in The Smiths name, or is there a benign motive at play? I adore Moz, but can't rush to judgment on this one.
Is he trying to get ahold of the licensing/merchandising rights ahead of a Smiths tour? Was Joyce consulted?

In any case, such actions would be subject to legal scrutiny, especially given Morrissey’s role in creating the name and the band's history. This is not a "Van Hagar" situation, where David Lee Roth was put on the shelf. I need to know more. And I'm sad that this seems to be getting sadder by the day, while Marr's silence hangs like Spanish moss.
 
A quick lookup of trademarks shows Johnny's company has owned THE SMITHS since 2018. How is Morrissey just finding out now? Was he trying to tour as the Smiths without Johnny? Checkmate!
He's probably angry Marr turn down a reunion and he's doing all of this as a some sort of revenge? He knows his fans are just as bitter as he is and they are already insulting Marr. Next he is gonna say Marr ruined his li😐

This can't be real surely? This feels like a nightmare. Is Morrissey still allowed to be called Morrissey from The Smiths?

Yes, everyone calm down! Marr's company has owned THE SMITHS trademark since 2018. It's business as usual for Morrissey, he just can't release records or play shows as THE SMITHS. Is he just finding out now or just complaining about it now to once again, make Marr into a villain.
 
"The Smiths" was registered by a games company the year before Johnny got his. And if you look at the entry for Johnny's trademark, the prospective uses are all about video games. I think he took out the trademark as a response.

Yes reading the details it seems to cover all aspects of the name. Perhaps Johnny was actually quite correct in nailing this all down, as team Moz seemed to have been asleep on all this. Again.
 
This is why they should at least be talking to each other. Reach for the phone instead of the nuclear button. Just an idea.
 
Like @Katsneezle pointed out, why does Morrissey is acting like this is something new, when Marr's company has owned The Smiths since 2018?

Class 41 seems to cover all aspects of performance as The Smiths.
